The following Terms and Conditions shall apply to your use of the Website owned and operated by FNP E Retail Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at FNP Estate, Ashram Marg, Mandi Road, Gadaipur, New Delhi-110030 (hereinafter referred to as “FNP” / “We” / “us” / “Ferns N Petals”) through its website (www.fnp.com) (hereinafter referred to as “Website”) under the brand name ‘Ferns N Petals’, that inter alia allows its users to browse, select and order a gifting item for their loved ones or relative or friend or family member or to the recipient as per the request of user. FNP provides this Website to customers in accordance with these Terms and Conditions. The customers hereinafter have been referred to as “You” / “User” / “Your”. These Terms and Conditions along with Terms of use, Disclaimer and Privacy Policy governs the relationship between the customers and FNP.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 read with Rule 5 of the Consumer Protection (E-Commerce) Rules, 2020 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of this Website.

These Terms and Conditions together with the Terms of use, Disclaimer and Privacy Policy and all other additional terms and conditions and policies posted on the Website (collectively referred to as “Terms and Conditions”) constitute a legally binding agreement between the user of the Website and FNP, being the owner of the Website. Please read the Terms and Conditions carefully before proceeding, as by completing the registration process and/or by using the Website, you signify your agreement with these Terms and Conditions. If you do not agree with any of these Terms and Conditions, then please do not access the Website and/or complete the registration process on the Website. In case of any discrepancy between these Terms and Conditions and any other content on the Website, these Terms and Conditions shall prevail. By confirming your acceptance to these Terms and Conditions, you hereby

(a) represent and warrant that you are entitled to enter into agreement with the Company and that no other person is accepting these Terms and Conditions on your behalf; and (b) accept the provisions of these Terms and Conditions and your responsibilities and obligations in all aspects related to your use of the Website and buying the products/services. If you confirm these Terms and Conditions as an employee, agent, contractor or other representative any entity, you hereby represent and warrant that you have the right and authority to validly bind such entity. FNP reserves right to add on or discontinue any services from its Website at its discretion.

As part of the Website, FNP may provide certain tools or guidance for the benefit of its users and to facilitate and support the selection, configuration and purchase of the products/services through the Website. Any information or guidance which may be provided by FNP to its users is solely for information purposes and the users, at their own discretion, may decide to follow such guidance.

FNP retains the right at any time to deny or suspend access to any or all sections of/services provided through the Website to any user, who FNP believes, has violated any of the provisions of these Terms and Conditions.

FNP shall be responsible for fulfilling your orders (either directly or through its delivery partners) including but not limited to issue invoice, deliver product to recipient, and in no event shall any of its affiliate, director, representative, officers, consultant or employee be responsible for transactions made on this Website.

Subject to the provisions of the Terms and Conditions, by conveying your acceptance to the Terms and Conditions, you are hereby granted a non-exclusive, non-transferable, limited and revocable right to access the Website for the purposes of buying the products/services.

While some of the content and pages of the Website are free to view, but to purchase the products/services, you may need to create an account on the Website. To create an account on the Website, you will be asked to complete the registration form and fill in certain details such as name, address, mobile number, e-mail id, etc. You expressly acknowledge that FNP will rely on the information as would be provided by you and thus you hereby warrant that any and all information provided by you in the course of creating the account is true and accurate. You will immediately inform of any changes to registration information including changes in the expiration date of any credit card or charge card used in connection with purchase of any products/services using the Website and changes in home or billing address.

Transaction on the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Website. If you are a minor i.e., under the age of 18 years, you may use the Website or access content on the Website only under the supervision and prior consent/ permission of a parent or a legal guardian.

FNP reserves the right, at its absolute discretion and without assigning any reason, to refuse any user from creating an account on the Website or to suspend or cancel an account. FNP also reserves the right to suspend or cancel at any time and without notice the account of any user who is found to be in breach of these Terms and Conditions or if any user who in the reasonable opinion of FNP is guilty of conduct which is detrimental to the reputation of FNP.

You hereby confirm and acknowledge that you shall be solely responsible for maintaining the confidentiality of your user name and password and restricting any unauthorized access and use of this Website using your user name and password. You will be responsible for all access to and use of this Website through your user name and password, including purchase of any Products which results in monetary charges being imposed onto you, whether or not you have the knowledge of or authorize such access and use. You will notify FNP immediately of any unauthorized disclosure or use of user name and password, or if you suspect the privacy of your user name and password has been breached and/or jeopardized. Until FNP is notified of a breach in security, you will remain liable for any unauthorized disclosure or use of your user name and password. You are cautioned, at your sole liability, to exercise particular care while using public networks/WIFI connection or accessing your account from public computers.

You shall not (i) select or use as a user name, a name of another person with the intent to impersonate that person; (ii) use as a user name, a name that is otherwise offensive, vulgar or obscene. FNP reserves the right to refuse registration of or cancel a user name in its sole discretion. You will be solely responsible for any and all activity that takes place in or through your account.

FNP also reserves the right, either by itself or through third parties, to offer alerts, newsletters, e-mails and other promotional offers to you based on the preferences that you identify during the registration process and at any time thereafter from your online account and/or based on your history of purchase of products/services from the Website.

In the course of operating the Website, FNP will be required to monitor your usage of the Website for legitimate purposes, such as (a) providing, maintaining and developing the Website; (b) preventing, detecting and repairing problems related to security and/or the operation of the Website; (c) creating reports, for e.g., number of products sold, revenue by each product category, etc.; and (d) improving the user experience for accessing the Website.

Seller:

FNP is selling the products on the Website which include third party products. FNP has legal authority to sell such third party products to the users via the Website.

Ferns N Petals Private Limited is a listed seller on the Website for its owned branded products. FNP is only a facilitator for the products sold by Ferns N Petals Private Limited. FNP is providing its support to Ferns N Petals Private Limited, associated with sales through the Website. For the products sold by Ferns N Petals Private Limited, it shall solely be responsible to the user with respect to product quality, warranty, accuracy, on-time deliveries and respective complaints. Ferns N Petals Private Limited shall be bound to these Terms and Conditions mentioned hereunder, to the extent related to the sales of its products through the Website.

Products:

All products listed on the Website, their descriptions, and their prices are subject to change from time to time. FNP and/or Ferns N Petals Private Limited reserve the right, at any time, to modify, suspend, or discontinue the sale of their respective products or services with or without notice.

We put every effort to ensure, that our Website contains correct information. However, FNP makes no warranty as to the accuracy, comprehensiveness and correctness of products and information on Website. Purchase of a product on the Website is subject to availability of stock.

We strive to offer you best possible rates of the product but FNP does not guarantee that these prices will be minimum in the region or country or in comparison to other players of the industry. FNP reserves the right to change or update the price and/or other details of the product on the Website, at its discretion, without any notice to you. In the event a product or service is listed at an incorrect price or with incorrect information due to typographical error, error in pricing or information received from FNP’s suppliers, FNP shall have the right, post the acceptance of any order, to decline or cancel any such order, whether or not the order has been confirmed and/or you have been charged for such product or service. If you have already been charged for the order and FNP cancels your order, the amount will be refunded.

On booking for decoration or instrumental play, you agree to allow FNP’s associates to visit your place for the performance of services, in pursuance to your order. Post booking and payment, our representative will contact you to re-check the time to visit you for such performance and make his/their arrangements accordingly. Such activities may be performed by our third party service provider and we are facilitating their services for your convenience only. We always try to give you safe and secure environment while performance of services but we expect you to maintain your privacy and apply your diligence while availing the services. You are requested to check the identity of service personnel and may counter check with FNP’s representative. We suggest you to be present at the place of performance for all time. We will not be responsible for any missing item at your place. For any grievance or deficiency in service you can contact us immediately. Any grievance on these services post 2 hours of performance will not be acceptable. For the performance at any hotel, you need to take permission from the concerned hotel. We shall not be responsible for cancellation of services and refund if you cannot take this permission from the hotel in a timely manner.

The product specifications (weight, size, colour etc.) mentioned with the product photos displayed are only approximate. There may be a slight variation in the pictures and the respective actual products.

There may be slight variation in the flower arrangements as compared to the pictures displayed on the Website as the flower arrangements are hand-made and occasionally, substitution of flowers is necessary due to temporary and/or regional unavailability issues.

Every cake we offer is handcrafted and since each chef has his/her own way of baking and designing a cake, there might be slight variation in the product in terms of design and shape. Occasionally, substitution of flavours/designs is necessary due to temporary and/or regional unavailability issues.

In such cases, our experienced team will ensure we deliver the product as close as possible to the description/photograph shown and will only substitute with items of equal or higher value.

The message on the complimentary message card, which is provided by FNP , can either be printed or hand written, depending upon where the delivery is scheduled for.

We request you to check and follow our care guide, available on the Website, to take care of your cakes, plants and flowers delivered by us.

Products with its information are displayed on the Website to invite offer from the user. When you make an order, you are making an offer to purchase, and such offer is subject to acceptance by us. Our communication (email/SMS/push notification) acknowledging your order does not signify our acceptance to your offer. FNP reserves the right, after receiving the order, to accept or decline or cancel your offer (in whole or in part). Offer shall be deemed accepted once it is dispatched to delivery, by FNP. No other act or omission on the part of FNP shall be considered as acceptance of offer or order by FNP. We may require additional verifications or information before accepting any order. In the event of a purchase, you will be required to accurately provide the recipient’s name, contact and shipping address. You agree that, if FNP cancels all or a part of your order, your sole and exclusive remedy is that:

FNP will not charge your credit/debit card or bank account for the cancelled portion of the order.

For your convenience, FNP accepts Visa, Master Card, RuPay, Paypal and American Express Debit Cards, Internet Banking, Digital wallets and UPI. Notwithstanding anything contained herein, any and all payments made by above mentioned options, either through payment gateway on the website or through FNP mobile application, are subject to specific terms and conditions of such third party payment gateways.

Substitution Policy

In an event where a product that you have ordered is out of stock or unavailable, we will contact you to give an option of an alternate product. If we are unable to get in touch with you, we will proceed with sending you the alternate product since we know that you are sending it to your loved one(s) on a special occasion and we would not want anything to dampen the spirit of the occasion.

Order Modification/Cancellation Policy

FNP reserves the right to cancel any order for any reason including under any unforeseen circumstances that may come in the way of your order that may be limitations on quantity available of purchase, error in product(s) or pricing information, or limitations of our credit department. Before cancelling any order, we will contact/ notify you.

Orders that are to be delivered the same day are processed immediately and usually cannot be modified/cancelled.. However, in case you want to modify/cancel an order, you can reach us on +91- 92124 22000/011-66766060 (7:00 AM to 1:00 AM, 7 days a week). If the order has not been prepared or is not out for delivery, we will try to modify/cancel the order for you. If the order has already been prepared/dispatched, it cannot be cancelled/modified and you will be charged for the order.

In other cases of order modification/cancellation, you shall give at least 24 (twenty four) hours' advance notice.

However, if the order has already been prepared/dispatched, it cannot be cancelled/modified and you will be charged for the order. In case of limitations of quantity available of purchase, error in product(s) or pricing information or any other unforeseen circumstances, we reserve the right to cancel your order. You will be notified via email/sms regarding order cancellation and refund.

Order/Delivery Confirmation E-mail and SMS

You will receive an order confirmation on e-mail ID and SMS after order placement on the Website/App which will include all the details of your order, including the order number which will be required in the event you need to contact FNP. You will also receive a delivery confirmation e-mail and SMS when your order gets delivered. Please check your registered phone number or email address for details.

Shipping & Delivery Policy

FNP shall endeavour to deliver the products to the recipient as per the delivery option selected by the user while placing the order. The delivery time is subject to location you provided for delivery. For the convenience and requirement of the customer, FNP provides two options of deliveries, ‘Fixed Time Deliveries’ and ‘Free Deliveries’. FNP charges nominal amount from customers for selecting fixed time delivery and such charges are display on the webpage while selecting the timeframe for delivery. However, under fixed time deliveries, FNP is obliged to deliver your product as per your opted time but it is always subject to factors beyond its reasonable control (“Force Majeure Events”) including unexpected travel delays from our courier partners and transporters due to weather conditions, political disruptions, strikes, war, lockdown or other unforeseen circumstances. In such cases, we will proactively reach out to you. Please check your e-mails and SMS regularly for updates.

Flowers may be delivered in fully bloomed, semi-bloomed or bud stage. The delivery cannot be redirected to any other address.

Before any festival or major occasions, we suggest you to place your order at least 5 (five) days in advance.

Products that are hand delivered cannot be delivered along with courier products. The products may reach to the recipient at two different times or days.

  • For same-day standard time delivery, orders must be received by FNP before 6:00 pm, Monday - Sunday, IST.
  • For same-day fixed time delivery, orders must be received by FNP before 6:30 pm, Monday - Sunday, IST.
  • For same-day midnight delivery, orders must be received by FNP before 7:00 pm, Monday - Sunday, IST.

You acknowledge that requested delivery time is non-binding. Estimated delivery time depends on the availability of the product and the destination to which you want the product to be delivered.

Delivery may be affected by and may take longer due to Force Majeure Events.

In such cases, we will proactively reach out to you. You must check your e-mails and SMS regularly for updates.

For perishable items like cakes and flowers, we attempt delivery of your order only once. In the event the delivery is not executed during the attempt, you shall still be charged for the order and no re-delivery will be possible. We will consider the order executed in the below cases:

  • Wrong shipping/delivery address.
  • Recipient not available.
  • Premises locked.
  • Recipient refusing to accept the delivery.

In case if the recipient is not available, he/she can inform the delivery person to deliver the order to the gate/reception/neighbour.

Proof of delivery will be provided in case of any dispute in delivery.

If there is no one available at the shipping addresses to accept the delivery of your order at the time of delivery, the order will not be considered late. Hence in such cases, no refunds, cancellations, liability can be made. We will surely try our best as mentioned below-

  • Call the recipient to schedule an appropriate delivery time.
  • Leave a note on the recipient’s door asking them to contact the florist to schedule a delivery time.
  • Leave the bouquet/arrangement in a covered, secure area of the home (porch, garage, or other entrance)
  • Leave the bouquet/arrangement with a neighbour and place a message on the recipient’s door with this information.

Midnight Deliveries

Subject to the other terms of the shipping disclaimer, delivery will be made between 11:00 PM to 11:59 PM on the chosen delivery date.

Note: Please choose the date of delivery a day prior to the date of occasion.

Fix Time Deliveries

While we will try our best to ensure the order is delivered as per the fixed time slot selected, subject to the other terms of the shipping disclaimer, the order could be delivered +30 or -30 minutes as per selected time.

Delivery of Courier Products

Notwithstanding anything contained in these Terms and Conditions, in the event the order is made to deliver through any courier agency or any third party, FNP does not make any representation or warranty in relation to the delivery of such orders. The products will be delivered through courier company and the delivery made by them are subject to the terms and conditions of such courier companies.

For products that are shipped using the services of our courier partners, the date of delivery is an estimate. Your order may be delivered a day prior or a day after the chosen date of delivery.

You acknowledge that requested delivery date of such products are non-binding. Estimated delivery date depends on the availability of the product and the destination to which you want the product to be shipped. Deliveries through third party courier agencies will not execute on Sunday and Public Holidays.

Our courier partners do not call prior to delivering an order, so we recommend that you provide an address at which someone will be present to receive the package. The delivery cannot be redirected to any other address.

All courier orders are carefully packed and shipped from our warehouse. Soon after the order has been dispatched, you will receive a tracking number that will help you trace your order. Courier partners sometimes have some delays due to holidays and strikes.

In case if the recipient is unavailable, we will attempt delivery twice and in case delivery location is incorrect or the recipient refuses to take the delivery, the delivery shall be deemed to have been made.

The courier company will attempt to deliver the package twice before the parcel returns back to the point of origin. In the event the delivery is not executed during the attempts, you shall still be charged for the order.

We will consider the order executed in the below cases:

  • Wrong shipping/delivery address.
  • Recipient not available.
  • Premises locked.
  • Recipient refusing to accept the delivery.

In case if the recipient is not available, he/she can inform the delivery person to deliver the order to the gate/reception/neighbour.

Delivery to Hospitals Policy

The FNP florists are experienced at making deliveries to hospitals. When placing your order, please be sure to include the following information:

  • Hospital name
  • Full address of the hospital
  • Telephone number of the hospital
  • The name of the recipient
  • Room number or ward of the recipient

We will send your order in accordance with facility procedures, as most hospitals do not allow florists to personally deliver to individual rooms. Please note that many ICU patients are not permitted to receive flowers. Please check with the hospital norms before placing such orders.

Delivery to Hotels Policy

Our Delivery personnel and partners have experience of making deliveries at hotels. However, please ensure that following information is made available while placing the order:

  • Hotel name
  • Full address of the hotel
  • Telephone number of the recipient and the hotel
  • The name of the recipient
  • Room number of the recipient
  • Name of Tour Company, if applicable

If the recipient has not checked in at the hotel on the delivery date, the order will be left at the reception and the order will be assumed as executed. If the person has checked out of the hotel by the delivery date, the order will be assumed as executed and no refund will be made in such cases.

Delivery to Wedding Halls/Marriages Policy

For delivery of order items to wedding ceremonies/ marriage halls, we may not be able to assure the delivery to the bride and/or bridegroom. Therefore, you shall provide the details of the alternate person to whom the delivery shall be made in such circumstances. However, if the concerned person is not available to take the order, we shall ensure that the delivery is made to one of the family members of the bride/bridegroom.

Delivery to Hostels/PG/Cantonment/Enclosed Premises

FNP florists are experienced at making deliveries to hostels/PG/Cantonment/Enclosed Premises. However, please be aware to make the following information available:

  • Hostel name
  • Full address of the hostel
  • Telephone number of the recipient and the hostel
  • The name of the recipient
  • Room number of the recipient

The recipient needs to either come to the gate of the premises to collect the delivery or send someone on his/her behalf after coordinating with the delivery person. The order can be handed over to security/any other responsible person or the order will be left at the reception and the order will be assumed as executed.

Delivery at Remote Locations and Towns

Orders can be delivered only in the cities available in our data bank. Remote location depends upon the location and availability of our store or associate. We cannot commit exact time of deliveries to such locations.

Please note that flowers, cakes and other perishable products are sourced locally at the delivery location. There are chances that our deliveries of natural plants & flowers or cakes are not available for such locations.

No deliveries would be done on national holidays. The delivery of the same would be done on the next working day. In case of floods/heavy rains/national bandh/election dates/curfews/traffic jams/ festival times/regulated traffic movements or any other impediments that may restrict the delivery of the order, FNP reserves the right to reschedule the delivery to another date.

Delivery to railway stations, Metro stations and airports

We do not deliver to railway stations, metro stations and airports.

Deemed Delivery

Under any class or category of orders, selected by customer, FNP will attempt delivery only once. In the event the delivery is not executed, due to following reasons, you shall still be charged for the order and no re-delivery will be possible. We will consider the order executed in the below cases (Deemed Delivery):

  • Wrong shipping/delivery address.
  • Recipient not available.
  • Premises locked.
  • Recipient refusing to accept the delivery.

In case the recipient is not available at given address, our delivery boy will try to contact the customer and the customer can inform the delivery person to deliver the product to the gate/reception/neighbour of recipient. As it would be a surprise for recipient, we avoid contacting the recipient in such circumstances. No request of cancellation, refund or modification would be entertained by FNP, in such cases. So, we request you to be sure about the details of recipient and his/her availability before placing the order.

On successful delivery, FNP’s representative or delivery personnel will request recipient for an acknowledgement of delivery. In case of refusal by recipient either to accept delivery or provide acknowledgment, the e-mail issued by FNP to user/customer on delivery or deemed delivery of product shall be a sufficient proof of delivery in case of any dispute with customer.

Duplicate Orders

If you have placed two or more identical orders by mistake, you shall inform the same to FNP. FNP shall give a full refund for the duplicate order, provided that the order has not been prepared or delivered. In any case FNP discovers that the same order has been made twice, it shall try to contact the customer to confirm the order. If the customer is not contactable, FNP shall be free to take the final decision on behalf of the customer.

Payment Terms

You agree to pay the price applicable and displayed for the product or service on our Website at the time you submitted your order, the delivery fees for the delivery service you selected, if any, or any applicable taxes (defined below). You will be solely responsible for payment of all taxes (other than taxes based on FNP's income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the purchase of the products and services not withheld by FNP.

All payments are non-refundable (except as expressly set forth in these Terms and Conditions). We reserve the right to charge late fees on all due payments required to be made by the customer which shall be equivalent to the higher of:

a) 1.5% (one point five percent) per month on the unpaid balance; or

b) the highest rate prescribed under the applicable law.

You agree to pay for all collection costs, attorney's fees, and court costs incurred in the collection of past due amounts.

"Convenience Charge" may be levied by FNP for facilitation of choosing a product/s and book the delivery, anywhere in India, without visiting our physical store. This covers FNP’s Internet and system handling costs.

Such Convenience Charges are correlated to the order value.

Payment Details

Order delivery is totally subjected to the payment credited in FNP’s account. Unless payment is received by us, the order will not be processed. FNP accepts payment via Visa, Master Card, RuPay, Paypal and American Express Debit and Credit Cards, Internet Banking, Digital wallets and UPI. All domestic and international cards are accepted by FNP.

You acknowledge that while making transaction on the website, you are not using any Credit or Debit card, digital wallet or UPI id fraudulently and you are duly authorized to use such card or payment mechanism. You agree to provide accurate and correct information of your card or the payment mechanism for such transaction. The liability for use of a card or any payment mechanism fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively yours. FNP doesn’t take the responsibility of any transaction which is processed without your consent and knowledge. The cardholder or the holder of any payment mechanism is solely and totally liable for the transactions and the amount charged on his/her A/c.

All payments made against the purchases on the Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on the Website.

Before shipping/delivering your order to you, FNP may request you to provide supporting documents (including but not limited to Govt. issued ID) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.

It is hereby further clarified that:

Transactions, transaction price and all commercial terms such as delivery, dispatch of products, etc. are as per principal to principal bipartite contractual obligations between the customer and

a) FNP and payment facility provided on the Website is merely used by the customer and FNP to facilitate the completion of the transaction.

b)You understand, accept and agree that the payment facility made available on the Website is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through Cash On Delivery, using the existing authorized banking infrastructure and credit card payment gateway networks.

Communications

Subject to terms of use and your registration on our Website, you agree to receive communications from us by e-mail, SMS or any other communication made electronically, verbally or physically through post. You agree that all agreements, notices, disclosures and other communications that FNP provides to you by e-mail or in any other aforementioned mediums satisfy any legal requirement that such communications be in writing.

In some cases, we will be contacting the recipient before delivery. If you wish we do not contact the recipient, please call our Customer Care at +91-92124 22000/011-66766060 between 7:00 AM to 01:00 AM to notify them about the same.

FNP being an occasion based gifting business, provides certain occasion reminder services wherein FNP would remind you in future year(s) concerning certain occasions. For this purpose, you agree to give your consent to be contacted by FNP through SMS, phone call and e-mail on your registered phone number and email id, to assist you with free occasion reminder service.

Feedback and Suggestions

At FNP, we make every effort to ensure that you receive excellent products and services. We strive hard not only to meet but exceed your expectations. If, at any time, you experience problems with an order or are not happy with our services, you can call us on +91-92124 22000/011-66766060 (7:00 AM to 1:00 AM, 7 days a week) or write to us at support@fnp.com. Your feedback and suggestions are important to us.

Note: Complaints need to be made within 48 (forty eight) hours from the time of delivery, after which we will not be able to register any complaints. Complaints against non-delivery needs to be made within 15 (fifteen) days from the date of delivery, after which we will not be able to register any complaints. In case of a defective or a bad quality product complaint, we will replace it. For quality purpose, we might have to get a reverse pick up done for that product before we can get a redelivery done.

Returns and Refund Policy

No returns are allowed. However, if the product received is damaged/defective/Wrong, then please report the issue to our customer support team within 48 hrs of delivery along with an image of the item delivered. Our team will contact you for additional details of the product delivered if required.

You may choose one of the following:

1. Get the product re-delivered or

2. Opt for a refund in the form of a gift certificate (refunded within 24 hours) or

3. Refund in the original mode of payment (amount shall reflect in your account within 7-10 working days as per standard banking timelines)

We do not offer refund in the following cases:

If Flowers, Plants, Cakes, Sweets or any other perishable items are delivered to an incorrect address provided by the sender.

If the recipient is not present at the delivery address provided by the sender or refuses to accept the delivery.

If product quality concerns are caused by improper handling of the product.

Note:

-Complaints need to be made within 48 hours from the time of delivery, after which we will not be able to register any complaints.

-Complaints against non-delivery need to be made within 15 days from the date of delivery, after which we will not be able to register any complaints.

-For quality purpose, we might have to get a reverse pick up done for that product, before we can get a redelivery done.

-We do not accept any request for product exchanges.

-In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment for the part undelivered.

Online refund will be processed by FNP on confirmation through email or phone call to the customer. Once the refund is processed by FNP, it takes 10 to 15 business days to reflect in your account as per standard banking timelines.

Warranty

Products can only be returned if they are under warranty period subject to warranty terms, available under product information on the Website. Warranty, against manufacturing defects for the products exists for all orders placed through the Website.

Warranty can be availed only against manufacturing defects and it cannot be claimed for defects due to mishandling of the products or normal wear and tear.

www.fnp.com can be used by a person who can be legally bound to contract under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you may use website only with the involvement of your parent or guardian. Exchanges

Products can only be returned if they are under warranty period subject to warranty terms, available under product information on the Website. Warranty, against manufacturing defects for the products exists for all orders placed through the Website.

Disclaimers, Limitations and Exclusions of Liability

FNP strives to provide you with access of the services for 24 (twenty four) hours on every 7 (seven) days of a week. The Website may not be available to you from time to time, for reasons including but not limited to unavoidable circumstances or for maintenance purpose. FNP makes no representations about the suitability, completeness, timeliness, reliability, legality in your jurisdiction, or accuracy of the information, materials, products, and services described or contained in this Website for any purpose. To the fullest extent permissible by applicable law, FNP disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non- infringement, system integration, data accuracy, and quiet enjoyment. FNP does not warrant that the Website, its servers, or e-mail sent from the Website are free of viruses or other harmful components.

FNP and its affiliates will not be liable for damages of any kind arising from the use of the Website, including, but not limited to direct, indirect, incidental, punitive or consequential damages or special damages, whether or not such damages were foreseeable. In no event will aggregate liability of FNP to you for any and all claims arising in connection with your use of the Website, the service, or the products listed on the Website, shall exceed INR 500/- (Indian Rupees Five Hundred)

You agree and acknowledge that this limitation of liability is an essential term of these Terms and Conditions and FNP would not provide the service or products listed on the Website to you without this limitation.

This limitation of liability section shall prevail over any conflicting or inconsistent provision contained in any of the documents comprising this Terms and Conditions. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, worms, trojan horses and other items of a destructive nature.

FNP and its affiliates will not be liable for any damages of any kind arising in relation to the following:

the use or consumption of products procured / manufactured by third parties; or

the products delivered to you by any third party. FNP assumes no responsibility for examining or evaluating the third party products and services. FNP does not warrant the offerings of, any third party products. FNP does not endorse, in any way, any third party products or services or website’s content thereof. Any claim in respect of the same shall be made directly with the third party.

If FNP is unable to deliver your order, then complete refund will be made. However, FNP shall not be liable for any other charges, loss of profits, emotional stress or any other liability etc. caused due to such non-delivery.

Due to a huge rush in orders during Valentine’s Day and Raksha Bandhan, the delivery status confirmation by email and SMS may arrive a little later. FNP strives hard to ensure the orders are delivered on time and in case of any delay, due to huge rush in orders, FNP shall intimate the same to you and attempt to deliver the order as soon as possible.

FNP’s customer care team is on its toes to ensure that you have a great experience with FNP. However, during the Valentine week and Raksha Bandhan, there may be slight delay in getting response from the customer care team. In such situation, you are requested to be patient. In case you have dropped us an email, be assured that it is being reviewed and will be answered back as soon as possible.

While we make best efforts to ensure we deliver your orders in a timely manner, due to huge rush during the Valentine week and Raksha Bandhan, we do not offer any fixed time guarantee. Orders are processed on first come first serve basis, delivery areas and other local conditions. For products that are shipped using the services of our courier partners during peak season, FNP does not guarantee an exact date/time of delivery of such orders.

PRIVACY

Your registration data and other information collected through the use of this Website is subject to the Privacy Policy. You acknowledge that through your use of this Website, you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer, as necessary and permitted under the applicable laws. TERMINATION OF REGISTRATION

These Terms and Conditions will remain in full force and effect while you are a user of this Website. Your registration on this Website may be terminated at any time at the sole option and discretion of FNP or if you are found to be in breach of these Terms and Conditions or if, in the reasonable opinion of FNP, you are guilty of conduct which is detrimental to the reputation of FNP.

GENERAL

In the event that any provision contained in these Terms and Condition is held by a court of competent jurisdiction to be contrary to any law, the remaining provisions of these Terms of Condition will remain in full force and effect. No joint venture, partnership, employment, or agency

relationship exists between you and FNP as a result of these Terms and Condition or your use of the Website.

Waiver: The waiver by FNP of one breach or default under these Terms of Use shall not constitute the waiver of any subsequent or other breach or default. Further, failure or neglect by either party to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other or same right on any later occasion.

No Assignment: These Terms and Conditions shall be personal to every user and you shall not assign, transfer, sublet, lease or delegate all or any of your rights and obligations, without FNP’s prior written consent. Up-dations/Modifications: You agree to be bound by these Terms and Condition, which may be updated or modified from time to time without any notice to you. Any changes or modifications become part of these Terms and Condition and shall apply immediately. By continuing to use this Website after such modifications or changes to the Terms and Conditions, you shall be deemed to give your acceptance of such modifications or changes. You may, at the sole discretion of the Company, be required to re-accept a substantially revised Terms and Condition to continue access to or use of the services provided through the Website. Governing Law and Dispute Resolution: The Terms and Condition shall be governed by and construed in accordance with the laws of India. Losses: FNP will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable by either you or us when you commenced using the Website.

Any rights not expressly granted herein are reserved.

Indemnity

You agree to indemnify, defend and hold harmless FNP, its affiliates, and all of their employees, agents, officers, directors, proprietors, partners, representatives, shareholders, servants, attorneys, accountants, predecessors, successors, and assigns from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and litigation expenses) relating to or arising in connection with (i) your use of and access to the Website (ii) your violation of any term of the Terms of Use and Terms of Use (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right (iv) any claim that one of your User Submissions caused damage to a third party and (v) use of the User Submissions by FNP.

Miscellaneous

The products, services and the site being offered by FNP hereto are subject to laws of the republic of India. If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the party's intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. From time to time FNP may offer special promotional offers which may or may not apply to your FNP account. To avail of such promotional offers, you agree to be bound by any additional terms and conditions for these special offers which are laid down by FNP. This t&c and the relationship between you and FNP will be governed by the laws as applicable in India. Any dispute(s) arising out of this t&c will be handled in the competent courts of Delhi, India. The failure of FNP to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. FNP does not guarantee it will take action against all breaches of this t&c. Except as otherwise, expressly provided in this t&c, there shall be no third-party beneficiaries to this t&c. This t&c constitutes the entire agreement between you and FNP and governs your use of the site, superseding any prior agreements between you and FNP with respect to the site.

Shipping & Delivery Policy

Please allow us 24 - 48 working hours, after the chosen date of delivery, to be able to give you an update on the order.

Flowers may be delivered in fully bloomed, semi-bloomed or bud stage.

Our partners do not call prior to delivering an order, so we recommend that you provide an address at which someone will be present to receive the package. The delivery cannot be redirected to any other address.

Subject to the other terms of the Shipping Disclaimer, the deliveries would be done between 10 a.m. to 6 p.m. Delivery may take longer due to:

  • Bad weather
  • Political disruptions
  • Other unforeseen circumstances

Before major occasions, we suggest that you place your order at least five days in advance.

Products that are hand delivered cannot be delivered along with courier products.

For perishable items like cakes and flowers, we attempt delivery of your order only once. In the event the delivery is not executed during the attempt, you shall still be charged for the order and no redelivery will be possible. We will consider the order executed in the below cases:

  • Wrong shipping/delivery address.
  • Recipient not available.
  • Premises locked.
  • Recipient refusing to accept the delivery.
  • No/Incorrect doorbell name

Delivery of Courier Products

Notwithstanding anything contained in the Shipping Disclaimer or in the Terms and Conditions, in the event the order is made to deliver through any courier agency or any third party, FNP does not make any representation or warranty in relation to the delivery of such order.

For products that are shipped using the services of our courier partners, the date of delivery is an estimate. Your order may be delivered a day prior or a day after the chosen date of delivery.

You acknowledge that requested delivery date is non-binding. Estimated delivery date depends on the availability of the product and the destination to which you want the product to be shipped.

Our courier partners do not call prior to delivering an order, so we recommend that you provide an address at which someone will be present to receive the package. The delivery cannot be redirected to any other address.

No deliveries are made by third party courier agencies on a Sunday and Public Holidays.

No deliveries shall be made on Fridays and National Holidays in UAE and other Islamic countries.

All courier orders are carefully packed and shipped from our warehouse. Soon after the order has been dispatched, you will receive a tracking number that will help you trace your order.

Courier partners sometimes have some delays due to holidays and strikes.
In case if the recipient is unavailable, we will attempt delivery twice and in case delivery location is incorrect or the recipient refuses to take the delivery, the delivery shall be deemed to have been made. The courier company will attempt to deliver the package twice before the parcel returns back to the point of origin. In the event the delivery is not executed during the attempt, you shall still be charged for the order.

We will consider the order executed in the below cases:

  • Wrong shipping/delivery address.
  • Recipient not available.
  • Premises locked.
  • Recipient refusing to accept the delivery.

In case of residential areas, the order may be left at the door or Post Box or with a neighbour or a note may be left for the recipient to pick the order from the local hub.

In case of business addresses, orders may be left at the reception.

Delivery to Hospitals Policy

The florists in our Ferns N Petals network are experienced at making deliveries to hospitals. When placing your order, please be sure to include:

  • Hospital name
  • Full address of the hospital
  • Telephone number of the hospital
  • The name of the recipient
  • Room number or ward of the recipient

We will send your order in accordance with facility procedures, as most hospitals do not allow florists to personally deliver to individual rooms. Please note that many ICU patients are not permitted to receive flowers. Please check with the hospital before placing your order.

Delivery to Hotels Policy

The florists in our Ferns N Petals network are experienced at making deliveries to hotels. However please be aware to make the following information available:

  • Hotel name
  • Full address of the hotel
  • Telephone number of the recipient and the hotel
  • The name of the recipient
  • Room number of the recipient
  • Name of Tour Company, if applicable

If the recipient has not checked in at the hotel on the delivery date, the order will be left at the reception and the order will be assumed as executed. If the person has checked out of the hotel by the delivery date, the order will be assumed as executed and no refund will be made in such cases.

Delivery to Wedding Halls/Marriages Policy

TFor delivery of order items to Wedding Ceremonies/ Marriage Halls, we may not be able to assure the delivery to the bride and/or bridegroom. However, we shall ensure that the delivery is made to one of the responsible member of host.

Delivery to Hostels

Our florists are experienced at making deliveries to hostels/PG/Cantonment/Enclosed Premises. However, please be aware to make the following information available:

  • Hostel name
  • Full address of the hostel
  • Telephone number of the recipient and the hostel
  • The name of the recipient
  • Room number of the recipient

The recipient needs to either come to the gate of the premises to collect the delivery or send someone on his/her behalf after coordinating with the delivery person. The order can be handed over to security/any other responsible person or the order will be left at the reception and the order will be assumed as executed.

Delivery to railway stations, Metro stations and airports

We do not deliver to railway stations, Metro stations and airports.

Duplicate Orders

If you have placed two or more identical orders by mistake, please let us know about it. We will give a full refund for the duplicate order, provided that the order has not been prepared or delivered.

If we find that the same order has been made twice, we will try to contact the customer to confirm the order. If the customer is not contactable, we will take the decision on your behalf and that will be final.

Payment Terms

You agree to pay the price applicable for the product or service on our website at the time you submitted your order (Product Price), the delivery fees for the delivery service you select, if any (Delivery Fees), or any applicable taxes (defined below). You will be solely responsible for payment of all taxes (other than taxes based on FNP?s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the purchase of the products and services (Taxes) not withheld by FNP.

All payments are non-refundable (except as expressly set forth in the Terms and Conditions). We reserve the right to charge late fees on all due payments equivalent to the lesser of 1.5% per month on the unpaid balance or the highest rate allowed under Applicable Law. You agree to pay for all collection costs, attorney?s fees, and court costs incurred in the collection of past due amounts.

Discounts are applicable only on a minimum cart value of Rs. 500 and above.

FNP doesn't take the responsibility of any transaction which is processed without your consent and knowledge .The cardholder is solely and totally liable for the transactions and the amount charged on his A/c.

Communications

  • Product quality problems caused by improper handling of the product.

A full refund for cancellations is allowed if made 24 hours or more for domestic deliveries and 48 hours or more for international deliveries, prior to the scheduled delivery date.

In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full.

Online refund is credited directly through the mode from which the customer has paid the money within 24 working hours. Once processed by FNP, refund takes 7 to 10 business days to reflect in your account.

Offline refund is credited once the customer shares the bank details post which it takes 7 to 10 working days.

Online refund is credited directly through the mode from which the customer has paid the money within 24 working hours. Once processed by FNP, refund takes 7-10 business days to reflect in your account.

Exchanges

It will not be possible for us to accept any request for product exchanges.

Damaged/Defective Products

If any product received by you is damaged/defective, you can let us know the same. You can call us at +91-9212422000 / 9755-248-248 (7:00 AM to 1:00 AM, 7 days a week) or send us an e-mail with the photographs of the same at support@fnp.com, within 48 hours of receiving the product. We will either deliver to you the new product or refund the amount to you. Subject to the Terms and Conditions, once refund is initiated by FNP, it takes 7-10 business days for the refund amount to reflect in your account.
